Department of Posts issued orders to keep in abeyance the orders on abolition of posts for the years 2005, 2006, 2007 & 2008.

The All India Unions of AIPEU Postman & MSE/Gr.D, AIPEU GDS (NFPE) & NUPE P-IV filed a case in Principle CAT, Delhi (during May 2012) praying not to abolish the vacant posts (DR) of Postman & Gr.D (MTS) of the years 2005, 2006, 2007 & 2008. The Pr. CAT issued stay orders (in OA No.1736/2013) on the issue and now the Department of Posts issued orders to all Chief Postmasters General to keep the orders in abeyance on abolition of posts in the circles.

Several post officesin state of acute disrepair

Chennai: Several major post offices in the city are on the verge of caving in due to the postal depa­r­tme­nt’s engineering wing ad­opting a lackadiasical app­ro­a­ch to renovation. A series of wa­­­ll collapses at the Park and Eg­­­­more post offices has had po­stal sta­ff fear that more such could occur.
Chetpet post office staff aver that their building will be next in line as the cracks in the ro­ofs are widening. Their rep­eated pleas to improve infrastructure have been disregarded. “Many post offices do not have even basic toilet facilities. We have brought this to the higher officials’ attention innu­m­e­rable times, but in vain,” com­plained a staff member of the Chetpet postal circle.
Restoration work has begun at the Park post office, where the mishap occurred when no one was present, but members of the Postal Union fear for th­eir colleagues in other post offices.
Chetpet post office that needs urgent renovation. 
Even the historic General Po­st Office (GPO) complex, near Parry’s Corner, constructed in 1884 and which is under Sch­edule One of the Heritage category, is awaiting renovation. “Fire is reported in many heritage buildings these days.
We should be more careful and start GPO’s restoration as soon as possible. There is no point in delaying the process,” said Dr S. Suresh, state convener, Ind­ian National Trust for Art and Culture Heritage.
Senior postal administrative officials said that all necessary measures were being taken in this regard which would allay the fears of their employees over dilapidated buildings. “Wo­rk is going on in some pla­ces: soon we will cover all the problematic regions,” said a senior India post official.

(a)  whether the Supreme Court has upheld the decision of High Court and CAT for providing the benefit of Sixth Pay Commission to Government employees who retired before Ist January, 2006;
(b) whether it is a fact that Supreme Court in its judgement has given benefit w.e.f. January, 2006;
(c) whether the Ministry has implemented the judgement of Supreme Court in totality while giving benefit to those retirees w.e.f. January, 2006; and
(d)  if so, details thereof and if not, reasons therefor?
ANSWER
MINISTER OF STATE IN THE MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS AND MINISTER OF STATE IN THE PRIME MINISTER’S OFFICE (SHRI V. NARAYANASAMY)
The orders for implementation of the decision taken by the Government on the recommendations of 6th CPC for revision for pension of past pensioners were issued vide this Department’s Office Memorandum(OM) dated 1.9.2008. The provisions of Para 4.2 of this OM were clarified vide this Department’s letter dated 3.10.2008.
The Central Administrative Tribunal, Principal Bench, New Delhi in its order dated 1.11.2011 observed that by the OM dated 3.10.2008 the original orders of 1.9.2008 have been modified. Hon’ble CAT directed that the past pensioners may be granted, w.e.f. 1.1.2006, a minimum pension @ 50% of the minimum pay corresponding to the pre-revised pay scale with reference to the fitment table applicable for revision of pay of serving employees.
Writ Petitions were filed in the Hon’ble High Court of Delhi challenging the above mentioned order.
In its order dated 29.4.2013, the Hon’ble Delhi High Court has upheld the order dated 1.11.2011. After considering the order of Hon’ble High Court of Delhi and various representations received in this regard, Special Leave Petition was filed by the Department of Pension and Pensioners’ Welfare in the Hon’ble Supreme Court of India.
Department of Pension & Pensioners’ Welfare filed an SLP in the Hon’ble Supreme Court against this order. This SLP came up for hearing on 29.7.2013 and was dismissed and the Review Petition was also dismissed.
Union of India has also filed SLP against the order dated 29.4.2013 in Writ Petitions No.2348/2012, 2349/2012 and 2350/2012 in the Hon’ble Supreme Court which came up for hearing on 19.11.2013. The Hon’ble Supreme Court directed to list the SLP alongwith CA No.8875-8876 of 2011 filed by Ministry of Defence and is now listed for hearing on 4.2.2014. The matter is therefore sub-judice.

India Post plans national ATM network

India Post plans to launch 1,000 ATMs in next six months, to bring all branches on single technology platform

Mumbai: India Post is going ahead with the rollout of a nationwide network of automated teller machines (ATMs) and bringing all its branches on a single technology platform, notwithstanding the reservations of the finance ministry and the Planning Commission over its proposal to venture into commercial banking.
The state-run postal service is among the 25 applicants that have sought a banking licence from the Reserve Bank of India (RBI). A four-member panel, headed by former RBI governorBimal Jalan, will scrutinize the applications to pave the way for the entry of a third set of private banks into India’s Rs.81 trillion banking sector in two decades.
India Post will use Infosys Ltd’s Finacle software to cover all post offices under the so-called core banking solution (CBS) over the next 14-18 months. It also plans to launch 1,000 ATMs nationwide in the next six months in the first phase, according to a senior official at the postal department who requested anonymity because he is not authorized to talk to the media.


The CBS process, which would allow India Post customers to access their accounts and perform transactions from any branch of the postal network, has already begun with the Greams Road Post Office in Chennai on a pilot basis. “The idea is to cover all offices as soon as possible,” said the official.
India Post has also begun work to set up 5,000 ATMs in select post offices across the country in two phases. The first two ATMs will come up in T Nagar in Chennai and Gole Dak Khana in Delhi by March, the official said.
As of 31 March, commercial banks in India had an ATM network of 114,014 machines, led by State Bank of India (SBI) with 27,175 ATMs, followed by Axis Bank Ltd (11,245), HDFC Bank Ltd (10,743), ICICI Bank Ltd (10,481) and Punjab National Bank (6,312).
The plan is to issue ATM cards to all savings deposit holders at India Post. As on 31 March, the department was managing Rs.6.05 trillion of deposits, nearly half the deposit base of government-owned SBI, the country’s largest commercial bank, and double that of the largest private sector lender ICICI Bank. Of this, about Rs.2 trillion is under the savings scheme in 280 million accounts.
Out of the total 155,000 post offices, 139,040 are in rural areas. About 6,000 people are covered on average by a post office in rural areas and about 24,000 in urban areas, according to a 2011 estimate by the postal department. Once the ATMs are in place, the post office savings bank account customers will be able to access their deposits through ATMs.
“Like every other aspirant for the banking licence, India Post is building up their capacity for banking services," said Abizer Diwanji, a partner and head of financial services at the consulting firm EY, formerly known as Ernst and Young.
“Building a unified nationwide network for financial services makes sense for the department to develop their financial service offerings, even if they do not get the banking licence,” Diwanji said.
India Post’s plan to venture into commercial banking has been opposed by both the finance ministry and the Planning Commission, which have reservations about the postal service’s ability to take up the role of a bank. The proposal is yet to get funding clearances from the Expenditure Finance Committee. The finance ministry has been opposing the plan arguing that the postal service doesn’t have the expertise needed in relevant areas, such as handling credit.
The Expenditure Finance Committee’s approval is required for proposals involving spending of more than Rs.300 crore and the setting up of new autonomous organizations, regardless of the amount. A new bank needs to have equity of at least Rs.500 crore.
The Planning Commission, too, has reservations on the banking plan, though the panel hasn’t overtly and officially spelled out its stand.
According to people familiar with the development, Montek Singh Ahluwalia, deputy chairman of the Planning Commissions, said in an internal note recently that arguments raised against India Post’s banking plan were strong and the proposal could be a bad idea.
An email sent to Ahluwalia on 3 December did not receive any response.
“There is a strong feeling in RBI that India Post doesn’t have the expertise to manage a bank,” said a financial services expert with a consultancy firm, requesting anonymity.
“While technology and reach are positives for the postal department, their lack of experience in dealing with credit is a big negative,” the expert said.
India Post is keen to set up a commercial bank under the name Post Bank of India, arguing that it can significantly boost financial inclusion in Asia’s third largest economy through its nationwide network of post offices. This will also enable India Post, which posted a loss of Rs.6,346 crore in fiscal year 2012, to make up for business lost over the years to private couriers and email services.
Losses have significantly increased in recent years on account of higher expenses.
While India Post’s banking plan is nearly two-decades-old, the department stepped up efforts towards it in 2006, conducting internal viability studies and seeking the opinion of consultancy firms. The move gathered momentum when RBI unveiled its final licensing norms for new banks in February.
The postal department, which had appointed EY to advise it on the plan, wants to open 300-400 branches after starting the proposed bank, with each branch managing a specific number of postal outlets.

Hon’ble Supreme Court of India has ordered the Delhi High Court to decide the prayer of NFPE & AIPEU-GDS (NFPE) in writ petition No. 1003 of 2013 to treat the three lakhs Gramin Dak Sevaks as civil servants for all purposes at par with other regular employees as per 1977 SC Judgment & to quash the GDS (Conduct & Engagement) Rules 2011.

Donate Liberally to NFPE Legal Expense Fund

The National Federation of Postal Employees and the All India Postal Employees Union (Gramin Dak Sevaks) had approached Hon'ble Supreme Court of India by way of filing Writ Petition (C) No.1003 of 2013.  There were two basic prayers apart from the consequential prayers in the Writ Petition.  These prayers are:-

“(i)    that a  direction  be  issued  to  the Respondent to treat the Gramin Dak Sevaks as Civil  Servants  for  all purposes at par with the other regular members of the civil services and regular employees in relation to all service matters including the pension and all retiral benefits,  and

(ii)    the Department of  Posts, Gramin Dak Sevaks (Conduct and Engagement) Rules, 2011 be declared invalid and unconstitutional.”

The matter was heard at some length on 13.12.2013 in Court No.2 as Item No.8 before a Bench comprising of Hon'ble Mr. Justice R.M. Lodha & Hon'ble Mr. Justice Shiva Kirti Singh.  The Federation and the Union were represented before the Hon'ble Supreme Court by Shri M.R. Calla, Senior Advocate [Former Judge of Rajasthan High Court & Gujarat High Court] along with Shri Uday Gupta, Advocate. Their Lordships were of the view that the issues raised in the Writ Petition are of importance and keeping in mind the fact that about 3 lakhs persons are serving as Extra Departmental Agents (Gramin Dak Sevaks) and are posted at various places in the Country, the issues raised can be considered by Hon'ble Delhi High Court and this would also avoid multiplicity of legal proceedings.

Hon'ble Supreme Court vide its Order dated 13.12.2013 directed as under :-

(i)              That Writ Petition (C) No.1003/2013 be transferred to Hon'ble Delhi High Court for consideration;

(ii)           That Registry of Hon'ble Supreme Court to transmit the entire record and proceedings to Hon'ble Delhi High Court;

(iii)        That Registry of Hon'ble Delhi High Court to register the Writ Petition under Article 226 of the Constitution of India and proceed with the matter.

            This is a Writ Petition  filed  under  Article  32  of  the      Constitution of India by the National Federation of  Postal Employees and All India Postal Employees Union GDS (NEPE). The principal prayers in the Writ Petition are, (one) that a  direction  be  issued  to  the respondent to treat the Gramin Dak Sevaks as Civil  Servants  for  all purposes at par with the other regular members of the civil services and regular employees in relation to all service matters including the pension and all retiral benefits,  and (two) the Department of  Posts, Gramin Dak Sevaks (Conduct and Engagement) Rules, 2011 be declared invalid and unconstitutional.

2.         Having regard to the controversy raised in the  matter, we are satisfied that the grievance of the petitioners can be adequately considered by the High Court under Article 226 of the Constitution  of India.

3.         Since about three lakh persons serving as Extra Departmental Agents (Dak  Sevaks)  are  concerned  about  the subject matter and they are spread all over the country, we are satisfied that to avoid multiplicity of proceedings  in  different  High  Courts,  it would be appropriate that the matter is considered by one High Court.

4.         We, accordingly, transfer this Writ Petition to the Delhi High Court for consideration.

5.         The Registry shall transmit the record and  proceedings of  the Writ Petition to the Delhi High Court.

6.         Upon receipt of the record  and  proceedings of the Writ Petition, the Registry of the Delhi High Court shall register the Writ Petition and proceed with the matter accordingly.

7.         So far as this Court is concerned, Writ Petition stands disposed of.
